Terms

1.1 These are the terms and conditions related to the provision of training services to you.

1.2 ‘We’ (Anglia CPR) recommend that you (the customer) review these terms and conditions prior to course booking. These terms detail who we are, how we provide services, our contract with you, bookings and other important relevant information.

Who we are and how to contact us

2.1 We are Anglia CPR, currently operating as a Sole Trader in the UK.

2.2 You can contact us via email info@angliacpr.co.uk or by completing an enquiry form on the contact us page.

2.3 We will contact and communicate with you via email with the address you have provided to us.

Our Contract with you

Bookings:

3.1 We will contact you via email to confirm your booking and commence a contract between you and Anglia CPR.

3.2 If we are unable to accept you booking, we will notify you via email and you will not be charged for the course.

Price and payments

3.3 The course cost/price of service will be indicated at the time of enquiry and confirmed at point of booking.

3.4 Upon acceptance of booking, an invoice will be sent to you. Full course payment must be made within 28 days of receiving the invoice, and in any event, prior to the training taking place, unless previously agreed with Anglia CPR. We accept payment via BACS.

3.5 We will send you an electronic invoice detailing this, and to confirm receipt of funds.

3.6 Failure by you to pay any charges will result in:

3.6.1 Training not being delivered

3.6.2 Certificates being withheld

3.6.3 Interest on charges from the due date until payment of outstanding balance shall incur as set out in the Late Payment of Commercial Debts (Interest) Act 1998 until payment is made in full of any such outstanding sums.

Changes and transfers

3.6 If you wish to make changes to your booking, please contact us via email info@angliacpr.co.uk to discuss. We will advise of any amendments to your course, such as cost and timings, and confirm these with you prior to changes be confirmed.

3.7 We reserve the right, in exceptional circumstances, to cancel or postpone a course at any time without liability. In these circumstances an alternative date, or refund will be provided. We will endeavour to provide you with as much notice as possible in the event of needing to cancel or postpone a course.

3.8 We reserve the right to make changes to the course, such in response to updates in guidance and standards. We will inform you of this prior to the course being delivered.

Your responsibilities

4.1 It is your responsibility to ensure that the training you purchase is suitable for your occupational requirements, fulfills your training obligations and the required level of first aid provision based on a first aid needs assessment and risk assessment

4.1 It is your responsibility to ensure that any attendee of the course is capable to attend and participate. Learning and undertaking the skill of CPR and First Aid requires hands on practice, notably the performance of chest compressions. All attendees will be required to confirm that are fit to participate at the start of the course. Anglia CPR will not accept any liability for loss or damage in relation to this (See below).

4.2 You will be responsible for providing an adequate training location and space for the course to be delivered, except in the circumstance where Anglia CPR has organised a course and associated training venue. This will be discussed and agreed prior to confirmation of course booking. You shall ensure that Anglia CPR has lawful access to the location at the times agreed at point of contract.

4.3 You shall provide any reasonable information to attendees to ensure safe and effective attendance and receipt of training.

4.4 You shall provide any reasonable information to Anglia CPR to ensure safe and effective organisation and delivery of training and access to course materials. This may include names, email addresses, current first aid certificates, and expiry dates.

Provision of services

5.1 From the contract commencement date, Anglia CPR will provide services of the highest quality, which is evidenced based and in line with UK standards.

5.2 We will ensure that courses are delivered with reasonable skill and care by accredited/approved trainers.

5.3 We shall ensure that we have suitable DBS checks and insurance, including professional indemnity and public liability, in place.

5.4 Anglia CPR shall not be liable for for any loss or damage suffered by the customer or their employees that results from your failure to follow any instructions provided.

5.5 Anglia CPR shall not be liable, howsoever caused, for indirect or consequential loss including but not limited to; loss of profits, loss of business, loss of income, anticipated loss of profits/business or income, loss of data, or loss of goodwill.

5.6 We welcome feedback and will actively seek this at course end with permission.

Confidentiality

6.1 Both parties (Anglia CPR and you) agree to keep confidential information confidential.

6.2 Not to disclose any confidential information to any other party or service, unless required to do so by Law or in the event of Safeguarding.

Intellectual Property

7.1 Use of the website includes viewing the website and its associated pages. You may only establish links to this website with permission from Anglia CPR. All intellectual property rights including, drawings, illustrations, diagrams, course literature and other documents issued by Anglia CPR will remain the property of the company and shall not be reproduced in any form without consent.

7.2 Equipment utilised during training sessions must be used following the instructions provided. Any loss or damage will be invoiced to you.

Limitation of Liability

8.1 Nothing in these Terms and Conditions will operate to limit or exclude liability of each party (Anglia CPR and you) for death or personal injury arising out of its negligence, or for its fraud nor any other liability which cannot be excluded or limited under applicable law.

8.2 Subject to the paragraph above, in no circumstances will either party (Anglia CPR and you) be liable to the other party for any loss of business, revenue, profits, anticipated savings or goodwill (whether direct or indirect) or for any indirect, special or consequential loss, arising out of or in connection with these Terms and Conditions and Anglia CPR’s courses.

Force Majeure

9.1 Anglia CPR will not be be liable for any failure or delay in performing obligations where such failure or delay results from any cause that is beyond the reasonable control. Such causes include, but are not limited to; power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of Anglia CPR.

These Terms and Conditions shall be governed by and construed in all respects in accordance with the laws of England and Wales. the courts of England shall have exclusive jurisdiction to determine any dispute arising out of or in connection with the Contract (including in relation to any non-contractual obligations).
